Creditors' Rights

Hahn Loeser's Creditors' Rights, Reorganization and Bankruptcy Area is comprised of a strong group of practitioners which combine to form a comprehensive practice group that is called upon repeatedly to represent substantial creditors (secured and unsecured) and creditors' committees in large national bankruptcies as well as on matters of regional and local significance.
 
Both our creditor and debtor clients rely on our significant knowledge in representing borrowers and Chapter 11 debtors with respect to restructuring their financial affairs. In addition to our recognized knowledge with the specifics of chapter 11 reorganizations and out-of-court workouts, our activities include providing our clients with advice from the various non-insolvency areas which are now, more than ever, affecting the decisions, tactics and strategies of the major players in the insolvency world.
 
We have also been particularly active assisting clients in the disposition and acquisition of financially troubled companies. Numerous subtle, yet crucial issues take on a larger scope when the business to be acquired is financially unstable.
 
Hahn Loeser's Creditors' Rights, Reorganization and Bankruptcy area is co-chaired by Daniel A. DeMarco and Nancy A. Valentine, both of whom are listed in the 2013 edition of The Best Lawyers in America, as well as in the 2013 edition of Chambers USA: America's Leading Lawyers for Business where they were named "leaders in the field."

The team also includes Lee D. Powar, named by "Turnarounds and Workouts magazine as one of the country's Outstanding Bankruptcy Attorneys, and Alan S. Kopit, who also possess substantial experience in national cases. Hahn Loeser adds value through its skill and expertise in many challenging engagements.
 
Hahn Loeser recently concluded the representation of Corrpro Companies, Inc. (a publicly-traded provider of corrosion resistance technologies) in connection with the workout of its financial obligations to lenders and others, and Hahn Loeser previously made national headlines in our representation of Allegheny Health, Education and Research Foundation, which had $1.5 billion in debt and tens of thousands of creditors.
 
Recent chapter 11 debtor representations include PhoneTel Technologies, Inc. (the first pre-packaged chapter 11 case confirmed under the new guidelines for the U.S. Bankruptcy Court for the Southern District of New York) and Deaconess Hospital, LLC, an acute care hospital in Ohio. Hahn Loeser also prides itself on numerous creditors' committee representations of national significance including in the bankruptcy cases of PHD, Inc., Federated Stores, Inc. (the parent company for Federated Department Stores, Inc.), Enduro Stainless, Inc., Spinnaker Industries, Inc., The V Companies, and White Motor Corporation.
 
We have also taken leadership roles on behalf of major creditors that have been the driving force in important cases. These creditors include:
  • Cleveland-Cliffs Inc (in many major chapter 11 cases, including LTV Steel, WCI Steel, Weirton Steel and Rouge Industries)
  • USAA (in Pacific Gas & Electric's and Hauserman, Inc.'s chapter 11 cases)
  • The CIT Group (in dozens of chapter 11 cases)
  • Fleet Capital Corporation (Republic Technologies International LLC chapter 11 case)
  • SBA Towers, Inc. (in the Horizon PCS chapter 11 case)
  • Crown Castle USA (in Arch Wireless, Inc.'s and Network Services, LLC's chapter 11 cases)

Our extensive experience in bankruptcy affords us a distinct advantage in representing creditors, debtors and other parties-in-interest on non-bankruptcy matters, including out-of-court workouts, state and federal court litigation, and various transactional matters involving application of the provisions of the Uniform Commercial Code. We act to protect transactions, facilitate recovery and/or prompt settlement, depending upon applicable bankruptcy rights which may arise absent settlement. We understand and can employ the threat of bankruptcy as either a sword or a shield depending upon the interests of the party represented.
