Biography
Sean M. Ansberry focuses his practice primarily on complex business litigation lawsuits, including the defense of class actions.
His business litigation practice includes representing major corporations in the defense of class actions and against a variety of commercial claims, including ERISA, breach of fiduciary duty, uniform trade secret act, antitrust, breach of contract, defamation, and other tort claims.
The following are recent ERISA litigation decisions highlighting Sean's ERISA experience:
- Shaffer v. Rawlings Company, Case No. 3:09-CV-1578 (N.D. Ohio Dec. 2, 2009) (granting motion to dismiss plaintiff's nationwide class action for failure to state an ERISA claim).
- Voigt, et al. v. Aetna Health, Inc., Case No. 1:09-CV-481 (N.D. Ohio July 8, 2009) (granting motion to dismiss plaintiff's state law bad faith claim pursuant to ERISA preemption).
- Smith v. Owens-Illinois Hourly Employees Welfare Benefit Plan, et al., Case No. 2:06-CV-462 (S.D. Ohio Aug. 29, 2007) (granting Aetna's motion for judgment on the administrative record in holding that the decision to deny ERISA plan benefits was not arbitrary and capricious).
- Orzechowski v. York, et al., No. 1:06-CV-2430, 2007 U.S. Dist. Lexis 42931 (N.D. Ohio June 13, 2007) (dismissal of plaintiff's ERISA claim for failure to exhaust administrative remedies).
